The Sessions Court last week, convicted two brothers for assaulting a man to death with a hammer and paver block. The victim had intervened between the brothers and his friend, who was having an affair with the sister of the convicts, a day prior to the attack in May 2015. The brothers have been sentenced to life imprisonment.

According to the prosecution, the convicts, Uday Mandal (32) and Vikas Mandal (38), resided in the same locality as the deceased, Anis Sayyed (deceased), and his friend Javed Shaikh, in the Poisar area. It was alleged that Shaikh had been in a relationship with the Mandal brothers’ sister for the past one to two years, which the family disapproved of.

It was claimed that Sayyed and Shaikh frequented a chicken shop in the Poisar area, where, on May 10, 2015, the Mandal brothers approached Shaikh at 6 PM at the said chicken shop. They had sought out Shaikh to speak with him about his relationship with their sister and to urge him to end it. However, when Sayyed intervened, a scuffle ensued. The parties eventually separated and returned to their respective homes.

The next day, at 10 PM, while Sayyed was speaking to his friend, the Mandal brothers arrived at the spot. Uday was armed with a hammer, while Vikas carried a paver block. Before anyone could react, the brothers attacked Sayyed, inflicting severe head injuries and causing him to bleed profusely. Sayyed succumbed to his injuries. Meanwhile, his friend rushed to his house, which was just a minute away. As soon as Sayyed’s family reached the spot, the Mandal brothers fled. Sayyed was taken to the hospital, where he was declared dead. A murder case was registered with the local police station.

The postmortem revealed that Sayyed had 17 injuries, which were sufficient to cause his death. The defense argued that the injuries were the result of an accident, claiming that Sayyed had met with an accident and sustained these injuries. The defense also contended that there was no animosity between the families of the deceased and the accused.

However, the court noted the scuffle between the accused and the deceased the day prior to the attack. The court further pointed out that the accused failed to explain the presence of bloodstains on their clothing and questioned why the deceased’s family would falsely implicate the Mandal brothers if there was no animosity. The court held the brothers guilty of Sayyed’s murder.
