Mumbai – A court has said in its judgment that if the spouses threaten suicide and even try, it will be considered cruelty and it can be the basis of divorce under the Hindu Marriage Act.
Justice. RM Joshi rejected the woman’s second appeal. The woman challenged the family court verdict. The family court approved the divorce in favor of the husband and said that the woman was cruelly dealt with her.
Based on the husband’s argument, the court said that the wife had repeatedly threatened her and her elderly parents that she would commit suicide and implicate them in the case. The husband alleged that his wife once tried suicide by cutting the vein of his hand. When she was called as a witness, she applied henna on her hands to avoid interrogation and thus hidden the bruises. The court said in its decision of 20 February that such an act of wife forms the basis of divorce.
According to the husband, his wife has accused his father -in -law of drinking alcohol and assaulting her to dissolve her modesty. However, the court said that the wife could not prove the charge against her husband and father -in -law.
The order said that the court found that there was no error in the divorce decision given by the Family Court, so the appeal is rejected.
