A week after the special SC ST court ordered to implicate Dr Payal Tadvi’s department head, Dr Ching Ling, as an accused in connection with the 26-year-old PG medical student’s suicide case, the law and judiciary department on Friday replaced the senior special public prosecutor, Pradeep Gharat, from the case.

The law and judiciary department of the state government, on Friday, issued notification cancelling the appointment of Gharat as special public prosecutor in the case and has appointed criminal lawyer Mahesh Mule as special public prosecutor in the case. The family of Dr Tadvi’s husband, Dr Salman, expressed shock over the state government’s move and said the trial in the case has already been delayed.

According to sources, the move came after the court ordered to implicate Dr Ching Ling as an accused, allowing the plea filed by Gharat as special public prosecutor.

It was pleaded by him that instead of taking the action against the chargesheeted accused (three senior doctors of Tadvi), the proposed accused (Dr Ling) encouraged and provoked them. Thus, by her act of omission to prevent the offence and advising the victim that she had to bear such trouble and work, she has furthered and facilitated the commission of the offence.

The court had, on February 28, allowed the prosecution’s plea and ordered to summon Dr Ling to implicate her in the case. The detailed order, however, is not yet available.
