Rent agreement is made for only 11 months, know the reason

Indian law has rules for tenants, including laws related to rent agreements. Although there are 12 months in a year, it is not mandatory to register the rent agreement or lease agreement for a period less than one year under Section 17 (D) of the Indian Registration Act, 1908. This means that landlords can make a rental agreement for only 11 months without any registration. That is, the landlords and tenants do not need to go to the sub-registrar office to register the documents and pay the registration fee while renting the house.

Prominent role in disputes between tenants and landlords

According to experts, most of the laws related to rent in India are biased in favor of tenants. In such a situation, if the property owner has a dispute with a tenant and he wants to evict the tenant, then it is a very difficult task for him.

It acts like this in case of dispute

Due to a small mistake, the property owner has to fight a legal battle for his property for years. And this is a big reason that the notary rent agreement is made for only 11 months and is legally valid. If a dispute arises, the contract can be presented as evidence. If there is any dispute over the rent under the Rent Tribes Act and the matter goes to the court, then the court has the right to determine the rent. Then the landlord cannot charge more than that.

There is no need to get upset with the Registrar Office.

Another major reason for signing a rental agreement for 11 months is that no stamp duty and registration fee have to be paid for this period of the agreement. If the fare agreement is done for less than one year, then the stamp duty payable on it is not mandatory. The 11 -month fare is in favor of the landlord. The fare contract fee is payable by the tenant. Generally, a notary fare charges a fee of Rs 1000 to draft the agreement. 100 or Rs. 200 stamp paper is used.
