Up bulldozer action: The Supreme Court has rejected the contempt petition filed against Uttar Pradesh officials and directed the petitioner to appeal to the High Court. The petitioner says that the authorities have violated the Supreme Court’s order of 13 November 2024, which banned the bulldozer without giving notice or running a bulldozer during the hearing.
The factory was the only source of income.
Justice Bhushan Ramakrishna Gavai and Justice K.K. A bench of Justice Vinod Chandran has asked the petitioner to appeal to the High Court. The applicant said that on 10 and 11 January 2025, a bulldozer was run on his property in Sambhal. For this, no instructions were issued by the system nor any notice was issued. The factory was the only source of income for me and my family and this action of the authorities has put my and my family’s life in danger. However, the Supreme Court has stayed such action in November itself. Significantly, earlier on January 24, the court postponed the hearing for a week.
Supreme Court issued guidelines
On 13 November last year, the Supreme Court issued guidelines for the entire country during the hearing of the petition filed against bulldozer action. It was said that such action should not be taken without a show cause notice and 15 days time should be given for reply.
Many other points were also included in the court order and it was clarified that these guidelines would not apply to unauthorized structures near any public place like road, street, pavement, railway line, river or water bodies, which were ordered to demolish Has been given by the court.
