Navi Mumbai: A 34 year old man from Thane has been booked under The Muslim Women (Protection of Rights on Marriage) Act, 2019 that criminalized instant triple talaq.
The accused husband identified as Samir Noor Mohammed Ansari (34), residing in Thane, allegedly gave instant triple talaq on a stamp paper and got it notarized, and sent it to his wife Shabnam (28) by post to her house in Airoli. The case has been registered with Rabale MIDC police and the further investigations are on.
The complainant, Shabnam Samir Ansari, is currently residing with her parents at Chinchpada area of Airoli, while her husband, Samir Ansari, resides in the Azad Nagar area of Thane. The couple married in May 2023.
However, within one and a half months of marriage, Samir left Shabnam, citing her her medical issue of scoliosis as the reason. Shabnam returned to her parental home in Airoli. Afterward, Samir started demanding money from Shabnam to take her back. According to the complainant, her husband and his family was aware of her medical issue before marriage.
Shabnam had also filed a complaint with the Navi Mumbai Women’s Cell. Following the complaint, police had started counseling sessions for the couple. Even then, her husband allegedly sent her an instant talaq throught post on a notorised Rs 100 stamp paper to her Airoli address.
After receiving the document on October 16, Shabnam filed a complaint with the Rabale MIDC police station with the help of Bharat Aade, the founder-president of the Swarajya Hindu Samaj Organization. “Based on the complaint, we have registered a case against the husband and we have called him for further investigations,” a police officer from Rabale MIDC police station said.
