In fact, during a rally in Karnataka during the 2019 Lok Sabha elections, Rahul Gandhi made a statement regarding the Modi surname. BJP MLA Purnesh Modi had filed a defamation case against Rahul Gandhi regarding this statement. After 4 years, on March 23, the lower court of Surat declared Rahul Gandhi guilty. Was sentenced to 2 years.

The High Court, while dismissing the bench petition of Judge Justice Hemant, said that Rahul Gandhi is trying to get relief on absolutely non-existent grounds.

There is no rule to stay the sentence passed by the lower court. Rather an exception. Which should be resorted to in rare cases. There are about 10 criminal cases pending against the application. Even after the complaint, another complaint against Rahul Gandhi was lodged by Savarkar’s grandson. Not stopping the punishment will not be injustice to Rahul Gandhi. No reasonable ground was given to stay the conviction. The order of the Sessions Court is just and proper.
