Mumbai: The Vakola police have registered an FIR against four police personnel for allegedly kidnapping and disobeying the directions of a public servant under the law in connection with a drug-planting incident that occurred in Kalina on August 30. The case was filed on December 19 against PSI Vishwanath Omble and constables Imran Shaikh, Sagar Kamble, and Shinde (also known as Dabang Shinde).
According to the FIR, the complainant, Dylan Estbeiro, 31, resides in Kalina, Santacruz East, and works for a private livestock. Dylan has a childhood friend, Shahbaz Khan. On August 30, at around 5.50 pm, Khan was resting at his home, while Dylan was sitting on a sofa behind Khan’s residence.
About The Case
Four unidentified individuals approached Dylan. One of them, wearing blue jeans and a blue shirt with white stripes, asked for Dylan’s name. After Dylan introduced himself, the man began inspecting him. Meanwhile, another individual in an orange shirt approached Dylan from behind. The first man allegedly placed a white substance in a small bag into Dylan’s left back pocket.
When Dylan questioned what had been placed in his pocket, the man accused him of possessing MD (a synthetic drug) and demanded to know where he had obtained it. The accused also inquired about the whereabouts of Sahbaz Khan. Dylan informed him that Khan was at his residence. At this point, two other individuals arrived at the scene. Around the same time, Dylan’s friend Sandeep also arrived.
Dylan, feeling scared, realised these individuals were police personnel when one of them in the orange shirt showed him a pair of handcuffs. The police personnel then took Dylan into a private vehicle (a Ford EcoSport). During the journey, two of the officers allegedly beat Dylan with their hands.
They brought him to the police chowki on Khar Danda Road Number 18, where they reportedly beat him with a belt and a stick, forcing him to confess that Shahbaz Khan had given him the substance. Dylan refused to comply. Later, one of the police personnel contacted Dylan’s father and told him to come and take Dylan back. Dylan was then seated in an autorickshaw and sent home.
At around 9 pm, Dylan returned home and met his friend Sandeep. Later, he met Shahbaz Khan and learned that Khan had viral CCTV footage showing the police personnel allegedly planting drugs in Dylan’s pocket.
Through further investigation, Dylan discovered that the four individuals were police personnel: Police Sub-Inspector Vishwanath Omble and constables Imran Shaikh, Sagar Kamble, and Shinde (Dabang Shinde), all attached to the Khar police station. Dylan subsequently filed a complaint at the Vakola police station. Nearly three and a half months later, the Vakola police registered a case sections 198 (Public servant disobeying law, with intent to cause injury to any person), 199 (Public servant disobeying direction under law), 137 (2) (kidnapping), 127 (1) (Wrongful confinement), 115 (2) (Voluntarily causing hurt), 118 (1) (Voluntarily causing hurt or grievous hurt by dangerous weapons or means), and 3 (5) (general explanations) of the Bharatiya Nayaya Sanhita.
